Trustees are regularly assisted, but assistance is being increasingly requested by directors who are being called to account by a trustee based on a defective root cause investigation.
One investigation – carried out together with IT specialists and forensic accountants – established that the management was withdrawing funds from the company on the basis of false invoices. This money was then used to buy luxury consumer goods. The shareholders bore the brunt.
In yet another investigation – carried out together with parties including handwriting experts – it was established that an agreement had been backdated. This was a crucial point in the debate between two quarrelling parties, with the issue of whether a certain agreement had actually been concluded being highly relevant.
