Our team Housing Associations can help you further

Our Housing Associations team is fully versed in social housing law. Our broad practical experience, expertise, and insight in the sector ensures short, clear recommendations which benefit you as a corporation. The Housing Associations team’s attorneys work for several medium and large corporations. We are up to date on current events, both for our client and in the market. We are involved with our clients. We continuously invest in market and judicial knowledge, allowing us to provide good, appropriate solutions.

Real estate law
We can be of service to housing associations in every aspect of real estate law, from renting to construction. Our vast experience and extensive specialisation enables us to respond quickly and decisively. We can answer questions and provide recommendations on:

  • Rental of housing, commercial space, and social real estate
  • Nuisance
  • Illegal occupation
  • Demolition, renovation, and restructuring
  • Living and care
  • Neighbour law
  • Apartment rights and Owners Associations
  • Building permits and zoning
  • Construction arbitration
  • Administrative law

Governance
The Dutch Authority on Housing Associations has made governance a central aspect of housing association supervision in the annual work plan for 2017. It is therefore important to have a housing association’s checks and balances well organised.

Our corporate law attorneys counsel housing associations on governance in the broadest sense of the word. They provide advice on:

  • Implementation of legal structure and risk management
  • Streamlining decision-making processes
  • Changes in statutes and regulations to ensure compliance with the Housing Act
  • Monitoring SGEI (services of general economic interest) and non-SGEI assessment frameworks; and
  • The consequences of separating SGEI and non-SGEI

Employment law
Housing associations often encounter employment law-related issues. Our employment law team consists of attorneys who focus specifically on housing associations. Due to their social nature, housing associations require a certain approach, which our experience and expertise helps us provide.

Privacy
Housing associations process large amounts of personal information, such as employee, supplier, and tenant information. To prevent abuse and unlawful use of personal information, privacy legislation imposes strict requirements on collecting, using, issuing, exchanging, or otherwise processing personal information. The Dutch Data Protection Authority enforces compliance with the legislation, and violations bear a number of penalties, including hefty fines. Violation of privacy legislation can also result in reputational damages. It is therefore important that housing associations comply with privacy legislation and regulations.

Our Privacy team advise housing associations on processing personal information, such as issuing third-party data and maintaining blacklists. We use the following privacy tools to help housing associations maintain compliance with privacy legislation and regulations:

  • Compliance check
  • Establishing/evaluating processor agreements
  • Data breach notification requirement
